To get a Marriage Certificate, the applicant will have to follow the below mentioned
Marriages in India are registered under the Hindu Marriage Act 1955 or the Special Marriage Act of 1945.As per the Supreme Court’s directives, issued in 2006, marriages must be registered irrespective of the caste, creed or religion to be considered legitimate. Failing to do so will cause it to become illegal.
Why to register Marriages?
The reason people do not consider it necessary to register their marriage is due to their ignorance towards the many benefits of registration. The stringent rules implemented by the court to register marriages are more of a social concern than personal interest.Benefits of Marriage registration are as follows:
- To ensure that the bride and groom are of legal age of marriage (18 for the bride and 21 for the bridegroom)
- Certificate of marriage is a legal proof for obtaining passport, visas and other primary documents.
- Marriage certificate is of importance while applying for loan or claiming bank deposits and Life insurances.
- Marriage registration is a valuable document in case of divorce or taking any legal action against any one of the spouse involved in an unlawful practice.
- Availing Tax exemptions, Medical reimbursement, housing and employment benefits.
- Receive social security, Medicare and disability benefits from the government.
- Smoothen the process of spouse’s property inheritance in case of death.
- Avail consumer benefits meant for married couples.
- Quick adoption process, availing public assistance and special loans.
- Government rules and regulations which otherwise would take a longer period of time are quickly completed in case of a registered marriage.
Marriage Registration Process:
The procedure of marriage registration tends to differ from one jurisdiction to another. There are two cases wherein the couples who are already married but have not registered their marriage or couples who are planning for a court marriage.
Marriage solemnized but not registered:
- The parties (married) must obtain a form in order to apply for registration which has to be filled in and submitted within a specified period time along with all the mandatory documents and a prescribed fee at the registrar office.
- The form filling procedure can also be done online.
Marriage solemnized but not registered:
- In case of ‘Court Marriage’ both parties submit a joint application along with the relevant documents at the registrar office.
- After a month notice, the parties along with three witnesses must appear in front of the registrar on a given fixed date.
- Signatures of the two parties and witnesses are obtained on the official documents. The marriage is solemnized and a certificate is issued in this regard.

Documents required for marriage registration :
- Applicatioin filled in and signed by both the parties.
- Attested copies of Age proof(10th mark sheet /12th mark sheet/Birth> certificate/School leaving certificate/Passport/Driving license)
- Applicatioin filled in and signed by both the parties.
- Attested copies of Address proof( voter ID/Ration card/Copy of Electricity Bill or Telephone bill/Driving License/Passport) .
- passport size photographs, each, of both the parties.
- Marriage invitation card (if marriage is already solemnized).
Special cases:
- In case of widow/widower remarriage death certificate of the spouse is required at the time of registration.
- Divorcee must submit a copy of the Divorce order in case of remarriage registration.
- A copy of Conversion Certificate in case of religion other than that mentioned in the Hindu Marriage Act(Hindu, Buddhist, Jain, Sikh).
- A certificate from the priest in case the marriage was solemnized in a religious place.
